1. What FICAFlow is

FICAFlow is a technology service that helps you collect, organise, and forward FICA / KYC information and documents. It is a collection tool only. We do not verify identity, we do not attest to the truth or currency of any information, and we are not an Accountable Institution under the Financial Intelligence Centre Act (FIC Act).

2. Your responsibilities

You warrant that the information and documents you submit are true, complete and not misleading. You are responsible for keeping your pack up to date and for who you forward it to.

3. No financial, tax or legal advice

Nothing on FICAFlow is financial, tax or legal advice. For advice on forex transactions, exchange control, emigration, tax residency or the FICA obligations of a specific accountable institution, consult a qualified adviser.

4. Fees

Personal subscriptions are R49 per year per profile. Business subscriptions are R99 per year per application pack. Fees are paid via Paystack and are non-refundable except where required by the Consumer Protection Act.

5. Acceptable use

You may not use FICAFlow to submit false information, to harass, or in contravention of any law. We may suspend accounts used to commit fraud, money laundering or terror financing and we may report suspicious activity to the Financial Intelligence Centre under section 29 of the FIC Act.

6. Businesses using FICAFlow

If you are a business forwarding links or receiving packs, you warrant that you are authorised to collect the information from your clients and that you remain the accountable institution of record. You agree to our Operator Agreement (see /legal/operator-agreement) for the POPIA processing relationship.

7. Limitation of liability

To the maximum extent permitted by law, FICAFlow's aggregate liability is limited to fees paid by you in the 12 months preceding the claim. We are not liable for any Accountable Institution's failure to perform its own CDD. Nothing in these terms limits liability that cannot be limited by law (e.g. POPIA enforcement, CPA s.61 product liability).

8. Governing law

These terms are governed by South African law and subject to the jurisdiction of the High Court of South Africa, Western Cape Division.
